City Clerk Frank Lesko called the Pre Council Session of the Springfield City Council to Order at 5:00 p.m., Tuesday, August 15, 2017 in the Council Chambers of the Municipal Center West.

Clerk Lesko read the ordinances on First Reading and assigned to the Committee of the Whole.

City Council Zoning Agenda:

Mayor Langfelder called the August 15, 2017 meeting of the Springfield City Council to order at 5:30pm. He asked everyone to join in reciting of the Pledge of Allegiance.

Clerk Lesko took the roll call of members.

Present: Alderman Redpath , Alderman Senor , Alderman Turner , Alderman Fulgenzi , Alderman Proctor , Alderman DiCenso , Alderman McMenamin , Alderman Donelan , Alderman Hanauer and Mayor Langfelder

Clerk Lesko announced that there is a quorum to conduct the City Council meeting.

Next, docket number 2017-011 for the property located at 926 S. 13th Street.

Petitioner(s): FOE Rental & Removal

Present Zoning Classification: R-2, Single Family and Duplex Residence District, Section 155.017

Requested Zoning Relief: Reclassify property to R-3(b), General Residence District, Section 155.018, with a conditional permitted use pursuant to Section 155.018(c)(6) and 155.211(2), Rehabilitation Homes.

Springfield-Sangamon County Regional Planning Commission Recommendation Is: Denial

Planning And Zoning Commission Recommendation Is: Concur with the Springfield-Sangamon County Regional Planning Commission and deny the petition as submitted.

Alderman Senor made a motion for discussion. Alderman DiCenso seconded the motion. The motion passed on a voice vote of 9-0. Alderman Senor asked that the petitioner come forward. Leonard Joyner 1720 East Pine spoke about his request to house ex-cons and he is trying to go through all the right steps to make that possible. Alderman Senor wanted to know what stage in their rehabilitation they are at while staying at the house. Mr. Joyner said that the house will be monitored and they are reducing the number of residents from 6 to 3. Mr. Joyner said they would not have transportation so there will be no extra cars parking on the street. Alderman Turner said there were some troubles at a house last year in her ward because there was not prober monitoring of the house, and she doesn’t want another house causing problems. She wants to know what he has done to correct some of the Planning and Zoning Commission concerns. Mr. Joyner said the main issue was the number of people living in the house. They have reduced the amount from 6 to 3 in the house. There was an objector to the zoning change, but his was an overall objection. Mr. Joyner said that he will be doing a majority of the work, but he will have help from other sources. Alderman McMenamin wanted to know from Dr. James Walton with Options Outreach Ministry if he has done this type of ex-convict rehabilitation housing in the past. Dr. Walton said that was the reason for their founding is to help ex-convicts get back on their feet. Alderman Senor made a motion to approve the submitted petition with an amendment to allow only 3 residents instead of the 6 as originally requested. Alderman Redpath seconded the motion.

Alderman McMenamin wanted to know if the objector is here tonight. Mr. Joyner said that he had notice that this would go before the Council tonight. He has gone through the neighborhood and answered residents’ questions. The major question was safety and that is what his main focus will be if this is approved.

The next item on the agenda is docket number 2017-028 for the property located at 519 Bruns Lane

Springfield-Sangamon County Regional Planning Commission Recommendation Is: Recommend approval of the requested rezoning to R-5(b) and approval of the requested variances pertaining to transitional buffer yards and setbacks but recommend denial of the requested variances pertaining to phasing the parking spaces, surfacing, and screening.

Planning And Zoning Commission Recommendation Is: Concur with Regional Planning Commission’s recommendation to approve the rezoning to R-5(b), variances pertaining to transitional buffer yards and setback and upon occupancy the parking lot must be paved and incompliance.

Alderman Donelan made a motion to approve the petition as submitted, but limited the variances request of 155.097, 155.112 and 155.13 for the number of parking spaces surface requirement and screening requirements to a period of one year instead of the requested two years. Alderman Redpath seconded the motion. Next, docket number 2017-029 for the property located at Southeast Corner of Old Jacksonville Road and Rachel Lane.

Springfield-Sangamon County Regional Planning Commission Recommendation Is: Approval.

Planning And Zoning Commission Recommendation Is: Accept Springfield Sangamon Regional Planning Commission recommendation to approve petition. Alderman Hanauer made a motion to accept the Planning and Zoning Commission recommendation to grant the petition as submitted. Alderman Donelan seconded the motion. Alderman Redpath wanted to know if this will be annexed into Ward ten or nine. Mr. McLaughlin said that in talking with County Clerk Gray this would be in ward ten. Alderman Turner wanted to know why the Council is addressing the zoning, before it is annexed into the city. CC Zerkle said this is pre-zoning and will not become in effect until it is annexed into the city. The city cannot zone outside of the city. The city can pre-zone and if any land annexed and it’s not pre-zoned it will be zoned R-1 by default. Jordan Dorsey with Dover Development said that there is an active annexation petition working its way through the proper channels.

The motion for approval passed 9-0 voting yes: Alderman Redpath , Alderman Senor , Alderman Turner , Alderman Fulgenzi , Alderman Proctor , Alderman DiCenso , Alderman McMenamin , Alderman Donelan and Alderman Hanauer

Next, 2017-031 for the property located at 1128 S. 5th Street.

Petitioner(s): KM & Jo Corp

Present Zoning Classification: R-5(b), General Residence and Office District, Section 155.021

Requested Zoning Relief: Reclassification to S-1, Neighborhood Commercial and Office District, Section 155.030, and a variance of Section 155.098, Required Accessory Off- Street Parking Spaces: Retail or Service Establishments not otherwise covered in this chapter to allow zero accessory off-street parking spaces instead of the 5 spaces required.

Springfield-Sangamon County Regional Planning Commission Recommendation Is: Denial of petition as submitted and approval of a use variance in the R-5(b) district to permit a tattoo parlor providing there is a closing time of 9:00 pm a variance of Section 155.098, Required Accessory Off- Street Parking Spaces: Retail or Service Establishments not otherwise covered in this chapter to allow zero accessory off-street parking spaces instead of the 5 spaces required.

Planning And Zoning Commission Recommendation Is: Accept Springfield Sangamon County Regional Planning Commission recommendation.

Alderman DiCenso made a motion to deny the variance requested. Alderman McMenamin seconded the motion. Alderman Redpath wanted to know what would trigger the 3/5 majority in passing the proposed motion. CC Zerkle said that there is a valid protest petition and it would require eight yes votes to grant the requested variance.

Brian McCormick of 540 Williams Street, Springfield and Jessica Leach 1001 5th Street in Pawnee spoke about what he wants to do with the building. He wants to continued using of the parking on the right of way on Vine Street; at most there are two or three clients in the shop at a time. He would like to get rid of a gravel strip and put in a lawn there and clear up some of the old dying bushes and replace with other landscaping. Alderman Proctor wanted to know if he has meet with the objectors. Mr. McCormick said that he has not. Alderman Redpath wanted to know how many signatures are on the protest petition. CC Zerkle said that this is not one of those protest petitions; this is a formal protest from the owner of the property adjacent to this property. Alderman Redpath wanted to know if the zoning petition is denied, can they still move in and run, but they just won’t have the additional parking. CC Zerkle said that the business is allowed to carry on. Alderman Turner wanted to know why the objector wouldn’t meet with the petitioner. Alderman DiCenso said that one of the objectors was having health issues, but she was not sure why.

PJ Staab of 1121 South 5th Street said that the valid protest is because the building is zoned residential office and not residential commercial or neighborhood commercial. Mr. Staab said that all of their homes and office spaces in the area have off street parking and comply with city codes on residential business zoning laws.

The motion for denial of the petition passed on a vote of 7-2 Alderman Redpath , Alderman Fulgenzi , Alderman Proctor , Alderman DiCenso , Alderman McMenamin , Alderman Donelan and Alderman Hanauer voting no: Alderman Senor and Alderman Turner

City Council Regular Agenda:

Next, Mayor Langfelder asked that Kate Peters and Jim Moody from Lincoln Land Charity Championship give an update on the tournament that took place last month. Miss Peters said that this year’s attendance was 13,750 which is an increase of 44% over the first year. The LRS Pro- Am participants this year was 142 people an increase of 104%. The total amount of sponsors increased by 67% and the charitable impact increase was 33%.

Almost seventy percent of the patrons at this year’s tournament were from Springfield and Central Illinois. Quincy and Peoria area had a large number of people coming to the tournament. There were out of state purchases from Iowa, Missouri, Indiana, New Hampshire, Ohio and Kansas. The total amount of hotel room nights for the tournament players and staff was 1,857 over the course of the weekend tournament. These numbers didn’t include spectators from outside the area or friends and family of players who came to Springfield for the tournament.

With the money that the Council approved from the Springfield Visitor and Convention Bureau, they were able to do some radio ads in the St. Louis market and a segment on satellite radio on the PGA channels program “Grill Room”. There was a spike this year in attendance so they had to get some spectator structures. Next year tournament will be June 25th through July 1, 2018.

Next, Mayor Langfelder asked Treasurer Buscher for the Treasurer’s Report. The Corporate Fund had beginning balance for the month of July 2017 $1,884,295. The City took in $11,012,961 and total disbursements of $7,904,925 with an ending balance for July 2017 of $4,992,331. Alderman Donelan made a motion to approve the Treasurer’s report. Alderman Hanauer seconded the motion. The motion passed on a voice vote of 9-0.

Next, Mayor Langfelder asked for a motion to dispense with a reading of the minutes of the August 2, 2017 City Council meeting and approve the minutes. Alderman Donelan made the motion with Alderman DiCenso seconding the motion. The motion passed on a voice vote of 9- 0.

Next, Mayor Langfelder asked for a motion to incorporate the Pre Council first reading of ordinances into the record of the Council meeting. Alderman Hanauer made the motion with Alderman Proctor seconding. The motion passed on a voice vote of 9-0.

Next, Mayor Langfelder asked to incorporate the pre-council reading of the consent agenda into the record. Alderman Redpath made the motion. Aldermen Proctor and DiCenso seconded the motion. The motion to incorporate the amended pre-council reading into the record passed on a voice vote of 9-0.

Next, Mayor Langfelder asked for a motion to put the consent agenda on final passage. Alderman Redpath made the motion for final passage. Alderman Proctor seconded the motion. The motion for approval passed 9-0 voting yes: Alderman Redpath , Alderman Senor , Alderman Turner , Alderman Fulgenzi , Alderman Proctor , Alderman DiCenso , Alderman McMenamin , Alderman Donelan and Alderman Hanauer

Next, Mayor Langfelder asked that agenda item 2017-355 be taken out of the remains in committee section and placed on tonight’s debate agenda for proposal of an amendment and final passage. Alderman Donelan made the motion to place the agenda item on the debate agenda. Alderman Redpath seconded the motion. The motion passed on a voice vote of 9-0.

Next, agenda item 2017-267 an ordinance authorizing the execution of an intergovernmental agreement between the Springfield Park District and the City of Springfield pertaining to the Ash Street underpass and the Stanford Avenue extension, for the Office of Public Works. Alderman Senor made a motion to send the agenda item back to committee. Alderman Turner seconded the motion. The motion passed on a voice vote of 9-0.

Next, agenda item 2017-355 an ordinance authorizing purchase of a 2015 CAT 407C Telehandler with two bucket attachments from Altorfer Inc. for an amount not to exceed $91,000.00 for the Office of Public Works. Alderman Redpath made a motion to place the agenda item on final passage. Alderman Hanauer seconded the motion. Mayor Langfelder offered an amendment to the agenda item that would lower the dollar amount from $91,000.00 to $85,500.00 and would be a 2017 model instead of a 2015 model. Alderman Donelan made a motion to accept the proposed amendment. Aldermen Hanauer and Proctor seconded the motion. The motion to amend the agenda item passed on a voice vote of 9-0.

The motion for approval of the amended agenda item passed 9-0 voting yes: Alderman Redpath , Alderman Senor , Alderman Turner , Alderman Fulgenzi , Alderman Proctor , Alderman DiCenso , Alderman McMenamin , Alderman Donelan and Alderman Hanauer

Next, agenda item 2017-383 an ordinance authorizing addendum A to a redevelopment agreement with Springfield Urban Redevelopment LLC, previously authorized by ordinance 029-01-17, for financial assistance for the property located at 501 East Capitol Avenue utilizing Central Area Tax Increment Finance Funds in an amount not to exceed $985,000.00 for the Office of Planning and Economic Development. Alderman Proctor made a motion to return the agenda item back to committee. Alderman Hanauer seconded the motion. Mayor Langfelder said that they would like to restructure some tax items. Alderman McMenamin asked if that would change the amount of the request from the TIF funds. Mayor Langfelder said it might be more due to the new market tax credits and historic tax credits. CC Zerkle said any change in the dollar amount would still have to go through the EDC. The motion passed on a voice vote of 9-0.

Next, agenda item 2017-387 an ordinance approving the reappointment of H. Edward Cramer, P.E. to the Mechanical Commission. Alderman Hanauer made a motion to place the agenda item on final passage. Alderman Proctor seconded the motion. The motion for approval passed 9-0 voting yes: Alderman Redpath , Alderman Senor , Alderman Turner , Alderman Fulgenzi , Alderman Proctor , Alderman DiCenso , Alderman McMenamin , Alderman Donelan and Alderman Hanauer

Next, Mayor Langfelder entertained a motion to suspend the rules and add to the first reading agenda item 2017-401 an ordinance authorizing the execution of a tentative agreement with the International Union of Operating Engineers, Local 965, on behalf of the Office of Public Works, from June 1, 2017, through May 31, 2020. Alderman Redpath made a motion to place the agenda item on first reading. Alderman Donelan seconded the motion. The motion passed on a voice vote of 9-0.

Next, Mayor Langfelder entertained a motion to suspend the rules and pass on emergency passage agenda item 2017-402 a resolution stating the City of Springfield’s strong support of Civil Rights and opposition to racism and discrimination of all kinds, for emergency passage. Alderman Turner made the motion to pass the resolution on emergency passage. Aldermen Redpath and DiCenso seconded the motion. Alderman Turner said she is sad that this has to be done in this day in age. The ability as a city to take a stand against racism is extremely important. She is proud to cosponsor this with the Mayor and asked if any other would like to cosponsor this with her. All the Aldermen said that would like to be cosponsors. The motion for approval passed 10-0 voting yes: Alderman Redpath , Alderman Senor , Alderman Turner , Alderman Fulgenzi , Alderman Proctor , Alderman DiCenso , Alderman McMenamin , Alderman Donelan Alderman Hanauer , and Mayor Langfelder

Next, Alderman Redpath wanted to know if the city has turned over ownership of the city garage on Monroe over to the Wyndham Hotel. CC Zerkle said that the city still owns the garage. The new agreement switches responsibility for future maintenance to the Wyndham Hotel.

Next, Alderman Senor wanted to invite people out to the Southeast Spartan Football teams clean up day on Saturday, August 19 at 7:30 a.m. The cleanup will be along Taylor Avenue, Ash Street and the surrounding neighborhood. They will meet at the Southeast parking lot at 7:30 a.m.

Next, Mayor Langfelder mentioned that today is City Hall Selfie Day and, he would like the Aldermen to stick around and take a selfie with him after the meeting.

Next, Mayor Langfelder asked for a motion to adjourn the council meeting. The motion was made by Alderman Hanauer and seconded by Alderman Donelan. The motion passed on a voice vote of 9-0. The August 15, 2017 City Council Meeting adjourned at 6:51 p.m.
