City Council Regular Agenda:

Mayor Langfelder called the May 2, 2017 meeting of the Springfield City Council to order at 5:30 pm. He invited everyone to recite the Pledge of Allegiance.

Clerk Lesko took the roll call of members.

Present: Alderman Redpath , Alderman Senor , Alderman Turner , Alderman Fulgenzi , Alderman Proctor , Alderman DiCenso , Alderman McMenamin , Alderman Theilen via phone , Alderman Donelan , Alderman Hanauer , and Mayor Langfelder

Clerk Lesko announced there was a quorum for a meeting.

Next, Mayor Langfelder entrains a motion to allow Alderman Theilen to attend the meeting electrically via phone. Alderman Turner made a motion to allow Alderman Theilen to attend via phone. Aldermen Proctor and Hanauer seconded the motion. The motion passed on a voice vote of 9-0.

Next, Mayor Langfelder presented Lincoln Library Director Nancy Huntley with a proclamation congratulating her on a great career as director of the public library for over twenty-four years and nearly forty years working in the library.

Next, Mayor Langfelder asked Adena Rivas the city’s recycling coordinator, to give an update on some of the events that took place on Earth Day. Miss Rivas said that moving the event to the Old State Capitol for the last couple of years is making the event become bigger. There were other events going on downtown that helped with the bigger attendance this year.

Next, Mayor Langfelder asked Fire Department Chief Barry Helmerichs to give a presentation on the insurance classification improvement the Fire Department just received. The increased rating was achieved by using existing department resources and personnel. Every member on the fire department contributed to this upgrade. The Insurance Services Office has a Public Protection Classification program. Insurance companies use the PCC information to establish fair premiums for fire insurance. Communities used the PCC as a benchmark for measuring the effectiveness of their fire protection services. The Public Protection Classification uses a point based system determining different aspects of response time and efficiency. The four primary categories are Fire Department, Emergency Communications, Water Supply and Community Risk Reduction. The score increase from 72.55 in 2013 to 89.46 in 2017 this is an improvement of 23.3%. The department improved in all the areas and went from a class three to a class two classification. What this means to the community is that if all other factors are equal, the price of property insurance is lower than in a community with a poor PPC.

Next, Mayor Langfelder asked for a motion to dispense with a reading of the minutes of the April 18, 2017 City Council meeting and approve the minutes. Alderman Donelan made the motion and Alderman Hanauer seconded. The motion passed on a voice vote of 9-0.

Next, Mayor Langfelder asked for a motion to incorporate the Pre-Council first reading of ordinances into the record of the Council meeting. Alderman Hanauer made the motion with Alderman Proctor seconding. The motion passed on a voice vote of 9-0.

Next, Mayor Langfelder asked to incorporate the pre-council reading of the consent agenda into the record. Alderman Redpath made the motion. Aldermen Proctor and Hanauer seconded the motion. The motion passed on a voice vote of 9-0.

Next, Mayor Langfelder asked for a motion to place the consent agenda on final passage. Alderman Redpath made the motion to place the amended consent agenda on final passage. Aldermen Turner and Hanauer seconded the motion. Alderman McMenamin asked that agenda item 2017-186 be pulled from the consent agenda and place on the debate agenda. Next, agenda item 2017-186 an ordinance approving a standard agreement for professional services with Crawford, Murphy & Tilly Inc. in the amount of $71,440.00 for engineering services related to a redesigned Hunter Lake for the Office of Public Utilities. Alderman Redpath made a motion to place the agenda item on final passage. Aldermen Senor and Turner seconded the motion.

Alderman McMenamin wanted to know if the changes in the design of Hunter Lake are to avoid phosphorus runoff into the new lake. Doug Brown said that the Utilities were asked to look at a different size of a lake. Ted Meckes said that they are in the alternate study phase that would work and not work. This is one of the alternate versions of the lake that CWLP has to study and give a cost for the redesigned lake. This is to see if it is a viable cost alternate or not. Alderman McMenamin asked if this is a smaller version of the proposed Hunter Lake. Mr. Meckes said yes, this is eighteen or nineteen percent less than the original proposed lake.

Alderman McMenamin wanted to know if there was a memoriam about the exact reduction of the lake size. Mr. Meckes said no, the alternate studies are with the Corp of Engineers. Alderman McMenamin wanted to know where the eighteen percent came from. There was a study on what would meet the city’s needs and the study came back that the city would use 12.8 million gallons a day during an eighteen month drought. Alderman McMenamin wanted to know where the documented eighteen percent reductions are located. Mr. Meckes said it is the water need documents that are being reviewed by the court. Mr. Meckes has a draft copy of the document that the Corp has not approved yet. Alderman McMenamin wanted to know if he could share that document with the Aldermen. Mr. Meckes said that once the Corp approves the document he would share it with the Aldermen. Mr. Meckes doesn’t want to put out any false information till the Corp approves the plans.

Mayor Langfelder said that the reason for the redesign is for the phosphorus levels that could rise in Hunter Lake. There was a public forum about the environment protection and the city is doing a redesign to help in that process and to keep the phosphorus levels down. Aldermen McMenamin said that he is for this, but he wants all the information out there available for the public to view. There was a report that the Council paid for that looked at the phosphorus levels in Lake Springfield. The report said that there were 140 million dollars to defer maintenance to Lake Springfield, that will help reduce the levels of phosphorus in the lake. Mr. Meckes said that it is not an immediate need, but more of a long term need. Alderman McMenamin wanted to know if there is a timeline that some of the maintenance could take place. Mr. Meckes said they are working on a timeline. The plan is to install cover crops, grass filter strips, settlement basins so that there is less phosphors coming into the lake. Then there can be drugging done on the lake. The need is to stop what is coming into the lake, then attack what is in the lake. Alderman McMenamin wanted to know why certain public members request was eliminated and where is that in the documents. Mr. Meckes said that portion of the report has not come back to CWLP just yet.

Alderman Hanauer wanted to know from CC Zerkle should the city be releasing draft documents, since there can be large changes and major rewrites. CC Zerkle said that draft documents are not subject to FOIA request. However if there is a desire for more information, the Aldermen should meet with staff and receive a briefing from staff members and not circulate drafts.

Alderman Fulgenzi wanted to know when Illinois Department of Natural Resources would take over control of the lake. Mr. Meckes said during the construction phase of the process they will start to add input. CC Zerkle said that there will be a management agreement with DNR that will come before the Council.

Alderman McMenamin said the reason for the request for information is so that there can be a wise decision going forward with Hunter Lake.

Alderman Senor asked that the appointees come to the front to be recognized. First was William Washington who thanks the Mayor and Council for appointing him. Next, Heather Nunn thanked the Mayor and Council for his reappointment to the Police Community Review Board. Next, Joe Davis thanked everyone for appointing him to the retirees’ board. Next, Frank McNeil wanted to thank the Mayor for appointing him to the International Visitor Board. Next, Mark Hemp thanked the Council and Mayor for starting the retired employees board and letting the retirees have a voice. Next, Ben Schwarm wanted to thank everyone for considering him for the Police review board. Next, Gloria Hayes wanted to thank the Council and Mayor for allowing her to serve on the retirees’ board. Next, Jasmin Woolfolk thanked the Council and Mayor for appointing her to the Police review board. Next, Sister Linda Hayes thanked everyone for appointing her to the Police review commission and looks forward to serving on the board. Next, Mayor Langfelder entertained a motion to suspend the rules and add to first reading agenda item 2017-254 an ordinance authorizing execution of an agreement with 521 East, LLC for use of Central Area Tax Increment Finance Fund for an amount not to exceed $120,000.00 for acquisition of the property located at 521 East Washington Street. Alderman Redpath made a motion to place the agenda item on first reading. Alderman Fulgenzi seconded the motion. The motion passed on a voice vote of 9-0.

Alderman Senor wants these to go through the Economic Commission before agenda items are consider by the Committee of the Whole. Director Karen Davis said they will go before the committee next Tuesday.

Next, Mayor Langfelder entertained a motion to suspend the rules and add to first reading agenda item 2017-255 an ordinances authorizing execution of addendum E to a redevelopment agreement with Children’s Museum Foundation corporation to extend the completion date of the project to July 1, 2018 and authorize additional Central Area Tax Increment Finance funds in the amount of $130,000.00 for a total amount not to exceed $1,121,545.00 for property acquisition and rehabilitation. Alderman Proctor made the motion to place the agenda item on first reading. Alderman Senor seconded the motion. The motion passed on a voice vote of 9-0.

Next, Mayor Langfelder entertained a motion to suspend the rules and add to first reading agenda item 2017-256 an ordinance amending Chapter 153, Section 153.106, of the 1988 City if Springfield Code of Ordinances, as amended, pertaining to definitions of large scale developments. Alderman Redpath made the motion to place the agenda item on first reading. Alderman Hanauer seconded the motion. The motion passed on a voice vote of 9-0.

Next, Mayor Langfelder entertained a motion to suspend the rules and add to the first reading agenda item 2017-257 an ordinance authoring a three-year extension of an integrated supply agreement between Motor Parts & Equipment Corporation D/B/A Napa Auto Parts (“Napa”) and the City of Springfield, Illinois, for an amount not to exceed $4,994,000.00 from March 1, 2017 through April 30, 2020, for the Office of Budget and Management. Alderman Donelan made the motion to place the agenda item on first reading. Alderman Proctor seconded the motion. The motion passed on a voice vote of 9-0.

Next, Mayor Langfelder entertained a motion to suspend the rules and add to the first reading agenda item 2017-258 an ordinance authorizing the city of Springfield to annually return $1,400,000.00 of Central Area (Downtown) Tax Increment Finance funds beginning with funds accrued in 2017 and payable in 2018 to Sangamon County for disbursement to other taxing bodies beginning in calendar year 2018 and continuing until the funds accrued in 2028 and payable in 2029 are disbursed in calendar year 2029 for a total amount not to exceed $16,800,000.00 for the Office of Planning and Economic Development. Alderman Hanauer made a motion to place the agenda item on first reading. Alderman Senor seconded the motion. The motion passed on a voice vote of 9-0.

Next, Mayor Langfelder entertained a motion to suspend the rules and add to the first reading agenda item 2017-259 an ordinance authorizing the City of Springfield to return an additional $700,000.00 of Central Area (Downtown) Tax Increment Finance Funds accrued in 2016 and payable in 2017 to Sangamon County for disbursement to other taxing bodies in calendar year 2017 for the Office of Planning and Economic Development. Alderman McMenamin made a motion to place the agenda item on first reading. Alderman Turner seconded the motion. The motion passed on a voice vote of 9-0.

Next, Mayor Langfelder said that he gave his State of the City Address last week and passed out a handout to the Aldermen. The handout outlines some of the accomplishments and some of the goals in the coming years.

Next, Alderman McMenamin asked Police Chief Winslow to give an update on downtown patrols. He has seen some aggressive panhandler’s downtown. Chief Winslow said there haven’t been any undercover stings since the lawsuit against the aggressive panhandler ordinance.

Next, James Kieffer who resides at 332 North Lincoln, said that he signed a mowing contract with the City of Springfield this year. He was refused because when he turned the contract in, there were two contractors at the same household. He wants to know who to talk to so he can get this resolved. CC Zerkle said that his legal department is looking into this issue and will get back to him once they come up with a solution. Alderman Turner said that there is a process that is in place before the contracts go out. The way that the process works is that contractors have certain specific addresses that they mow during the entire season. In the past, the contractors were put on a list and there was confusion as to who mowed what lots. The reason for the “no more than one contract per address” is that there were four or five contacts in one household. Mr. Kieffer said the reason he changed his address this year, is because the city is not mailing out checks and have gone to direct deposit. He runs his business from one address and the check would be mailed to the business. CC Zerkle said that they are pulling the RFP and looking for any written rules when the contracts were validated.

Next, Alice Remeny of 1205 South Livingston; addressed the Council and stated she is upset with the garbage men. They are not getting all the garbage in the truck. Miss Remeny also wanted to thank Director Mahoney for the hard work he does.

Next, Mayor Langfelder entertained a motion for adjournment. The motion was made by Alderman Senor and seconded by Alderman Hanauer. The motion passed on a voice vote of 9-0. The May 2, 2017 Council Meeting adjourned at 6:57 pm
