Rosenthal joins lawsuit challenging Illinois legislative process

State Representative Wayne Rosenthal has joined fellow Republican lawmakers in a legal challenge against the Democratic leadership of the Illinois House and Senate. The lawsuit, filed in Sangamon County Circuit Court, seeks to enforce the Illinois Constitution’s Third Reading Rule concerning Senate Bill 328. This rule is intended to ensure public transparency as legislation progresses through each legislative chamber.

Senate Bill 328 would permit out-of-state plaintiffs to bring lawsuits against out-of-state businesses in Illinois courts. The American Tort Reform Association has urged Governor J.B. Pritzker to veto the bill, describing it as one of the “single worst bills we have seen this year, nationwide.” They warn that its enactment could lead to an exodus of businesses from Illinois and a decrease in new business investments.

Rep. Rosenthal, who is also suing Democratic leaders Senate President Don Harmon and House Speaker Emanuel “Chris” Welch, emphasized the importance of adhering to constitutional processes during the legislative session. He expressed hope that Gov. Pritzker will veto SB 328 but urged judicial intervention if necessary.

“It is sad that a practice that was used under now convicted felon Speaker Michael Madigan has become increasingly egregious, and Republicans continue to be cut out of the process as major pieces of legislation are rushed through the House and Senate,” said Rep. Rosenthal. “This session I believe the rules were suspended and ignored twenty-four times. Each time this maneuver is used the people of Illinois lose. This behavior must be challenged, or the Democrats will keep abusing their power.”

The Third Reading Rule represents the final stage for debate on bills as mandated by the Illinois Constitution, designed to allow legislators sufficient time for review and discussion.
