V. EXEMPTIONS UNDER SECTION 4d(3) OF THE PERSONNEL CODE 

A. Governing Rule – Section 1.142 Jurisdiction B Exemptions  

a) The Civil Service Commission shall exercise its judgment when determining whether a position qualifies for exemption from Jurisdiction B under Section 4d(3) of the Personnel Code. The Commission will consider any or all of the following factors inherent in the position and any other factors deemed relevant to the request for exemption:

1) The amount and scope of principal policy making authority;

2) The amount and scope of principal policy administering authority;

3) The amount of independent authority to represent the agency, board or commission to individuals, legislators, organizations or other agencies relative to programmatic responsibilities;

4) The capability to bind the agency, board or commission to a course of action; 

5) The nature of the program for which the position has principal policy responsibility;

6) The placement of the position on the organizational chart of the agency, board or commission;

7) The mission, size and geographical scope of the organizational entity or program within the agency, board or commission to which the position is allocated or detailed.

b) The Commission may, upon its own action after 30 days’ notice to the Director of Central Management Services or upon the recommendation of the Director of the Department of Central Management Services, rescind the exemption of any position that no longer meets the requirements for exemption set forth in subsection (a). However, rescission of an exemption shall be approved after the Commission has determined that an adequate level of managerial control exists in exempt status that will insure responsive and accountable administrative control of the programs of the agency, board or commission.

c) For all positions currently exempt by action of the Commission, the Director of Central Management Services shall inform the Commission promptly in writing of all changes in essential functions, reporting structure, working title, work location, position title, position number or specialized knowledge, skills, abilities, licensure or certification.

d) Prior to granting an exemption from Jurisdiction B under Section 4d(3) of the Personnel Code, the Commission will notify the incumbent of the position, if any, of its proposed action. The incumbent may appear at the Commission meeting at which action is to be taken and present objections to the exemption request.

VI. CLASS SPECIFICATIONS

A. Governing Rule – Section 1.45 Classification Plan  

The Commission will review the class specifications requiring Commission approval under the Classification Plan and will approve those that meet the requirements of the Personnel Code and Personnel Rules and conform to the following accepted principles of position classification:

a) The specifications are descriptive of the work being done or that will be done;

b) Identifiable differentials are set forth among classes that are sufficiently significant to permit the assignment of individual positions to the appropriate class;

c) Reasonable career promotional opportunities are provided;

d) The specifications provide a reasonable and valid basis for selection screening by merit examinations;

e) All requirements of the positions are consistent with classes similar in difficulty, complexity and nature of work; and

f) The relation of the class specifications to any applicable collective bargaining agreement.

B. Rehabilitation Case Coordinator I (revise)  

CMS CLASSIFICATION ANALYSIS: The Department of Human Services (DHS) requested a study of the Rehabilitation Case Coordinator I (RCC I), proposing revisions to the Desirable Requirements of the class. Recently, a keyboarding proficiency test and some automated multiple choice tests were discontinued by Central Management Services, including for the RCC I and II classes. Also, an additional year of related experience is proposed for the entry-level RCC I class standards. The requirements for the RCC II remain unchanged.

The extant Rehabilitation Case Coordinator I class specifications Desirable Requirements are:

• Requires knowledge, skill and mental development equivalent to the completion of four years of high school.

• Requires one year of clerical related experience, which must include keyboarding.

The proposed Rehabilitation Case Coordinator I Desirable Requirements are: 

• Requires knowledge, skill and mental development equivalent to the completion of four years of high school.

• Requires two years of clerical related experience that demonstrates incorporation of working-level proficiency and accuracy in performing keyboarding functions.

Although the keyboarding test for entry to the series has been eliminated, keyboarding remains an integral function of the RCC I and RCC II positions, and the proposed experience requirement language is enhanced to that regard. Additionally, the RCC I and the RCC II class specifications were reviewed for content relevance, user readability and clarity. With valuable, cooperative input from DHS, numerous language changes were made, as the class specification language has not been updated for some time.

C. Land Acquisition Agent III (revise)  

CMS CLASSIFICATION ANALYSIS: This study was requested by the Illinois Department of Natural Resources (IDNR). Recently, IDNR posted a Land Acquisition Agent (LAA) III position, as the only LAA III incumbent possessing the necessary skill set and credential had applied for retirement. The posting drew several applications, but all applicants were deemed unqualified according to current evaluative processes. An inadvertent oversight in the extant class specification language resulted in an unintended interpretation and application of requirements, which has been remedied in the proposed class specification attached.

After research and discussion internally and with IDNR Human Resources and agency subject-matter-experts, replacement language was drafted that correctly clarifies that applicants need possess experience in only one or more of the noted areas rather than in each area, to satisfy requirements. The “and” below should have read “and/or” to indicate that any one or more areas of experience satisfies the statement. The revision clarifies that point. Additionally, obsolete “preferred” appraisal-related courses were deleted from the LAA III Desirable Requirements section of the class specification; finally, “Requires possession of an appropriate valid driver’s license” replaces “May require…” in the Knowledge, Skills and Abilities section as travel is now required in the performance of duties.

This limited revision to the Land Acquisition Agent III class was expedited due to the hiring urgency facing IDNR. Central Management Services (CMS) Class Studies staff will revisit and perform a comprehensive review of the Land Acquisition Agent series. The Land Acquisition Agent I and Land Acquisition Agent II will undergo necessary review and revision to update the class specification and maintain alignment with the series. The LAA III will be further examined to determine if it should be split into two classes with one variation being a separate “stand-alone” class due to recent credential requirement changes (Certified General Real Estate Appraiser License) issued by the Illinois Department of Professional Regulation.

Extant class specification requirements are stated below: 

Education and Experience 

Requires knowledge, skill and mental development equivalent to the completion of four years of college with coursework in agriculture, real estate, forestry, pre-law, economics or related fields.

Requires four years of professional experience in land titles, real property appraisal, land acquisition negotiations, plat and plan preparation, property management and relocation activities.

May require possession of a current, valid real estate appraiser license.

Prefers evidence of completion of two certified courses offered through either the American Farm Management Appraisal Association, American Institute Real Estate Appraisers, Society of Real Estate Appraisers, American Right-of-Way Association.

Proposed class specification requirements are stated below:

Education and Experience 

Requires knowledge, skill and mental development equivalent to the completion of four years of college with coursework in agriculture, real estate, forestry, pre-law, economics or related fields.

Requires four years of professional experience in one or more of the following work roles or areas: review and analysis of real property titles; as a licensed or certified appraiser of real property; land acquisition negotiator; preparing plats or plans; property manager; director of relocation activities.

May require possession of a current, valid real estate appraiser license.

May require a Certified General Real Estate Appraiser License issued by the Illinois Department of Financial and Professional Regulation.

CMS CLASSIFICATION ANALYSIS: The Department of Central Management Services Bureau of Personnel Division of Technical Services Test Development Section (CMS Test Development) has worked with the Department of Corrections and Illinois State Police on a revision to the keyboarding/typing test associated with the Telecommunicator Trainee class used by both agencies due to disappointing testing results analysis. The current minimum qualification standard found in the Desirable Requirements Knowledge, Skills, and Abilities section of the Telecommunicator Trainee, Telecommunicator, Telecommunicator Specialist and Telecommunicator Lead Specialist classes is set at thirty words per minute (30 wpm). CMS Test Development, Class Studies and the agencies have agreed to lower the minimum qualification level to twenty words per minute (20 wpm) for the Telecommunicator Trainee class. This is necessary for both agencies to fill vacancies and improve recruitment levels.

CMS has elected to revise all of the Telecommunicator related classes that specifically reference the 30 wpm rate to treat the series of classes uniformly. We have proposed to remove the original statement, “Requires ability to type a minimum of 30 words per minute.” And replace it with, “Requires skill to keyboard/type accurately at an established minimum rate.”

If in the future the minimum qualification standard is raised or lowered again, then this general statement accomplishes two things:

1) maintains continuity in communicating to the general public and classification staff that a keyboarding/typing minimum rate requirement exists, and

2) doesn’t specify exactly what that rate is to avoid changing the class specifications every time the rate is changed, which would be the case if we elected to go with “Requires ability to type a minimum of 20 words per minute.”

The agencies may and will continue to refer to the specific rate in position descriptions and recruiting efforts. The revised class specifications are attached for reference to show the changes in context.

The Commission has power to disapprove new rules or amendments to existing rules submitted by the Director of Central Management Services. Such proposed new rules or amendments of existing rules submitted to the Commission shall be accompanied by a report of proceedings attending the prior public hearing required by law with respect to them. If the Commission does not disapprove new rules or any amendment to existing rules within 30 days following the receipt from the Director of Central Management Services, the new rules or amendments have the force and effect of law after filing by the Director with the Secretary of State.
