IV. PUBLIC COMMENT IN ACCORDANCE WITH THE OPEN MEETINGS ACT

MEMBERS OF THE PUBLIC ARE OFFERED AN OPPORTUNITY TO ADDRESS MEMBERS OF THE COMMISSION IN ACCORDANCE WITH THE OPEN MEETINGS ACT AND RULES OF THE CIVIL SERVICE COMMISSION.

V. EXEMPTIONS UNDER SECTION 4d(3) OF THE PERSONNEL CODE

A. Governing Rule – Section 1.142 Jurisdiction B Exemptions

a) The Civil Service Commission shall exercise its judgment when determining whether a position qualifies for exemption from Jurisdiction B under Section 4d(3) of the Personnel Code. The Commission will consider any or all of the following factors inherent in the position and any other factors deemed relevant to the request for exemption:

1) The amount and scope of principal policy making authority;

2) The amount and scope of principal policy administering authority;

3) The amount of independent authority to represent the agency, board or commission to individuals, legislators, organizations or other agencies relative to programmatic responsibilities;

4) The capability to bind the agency, board or commission to a course of action;

5) The nature of the program for which the position has principal policy responsibility;

6) The placement of the position on the organizational chart of the agency, board or commission;

7) The mission, size and geographical scope of the organizational entity or program within the agency, board or commission to which the position is allocated or detailed.

b) The Commission may, upon its own action after 30 days’ notice to the Director of Central Management Services or upon the recommendation of the Director of the Department of Central Management Services, rescind the exemption of any position that no longer meets the requirements for exemption set forth in subsection (a). However, rescission of an exemption shall be approved after the Commission has determined that an adequate level of managerial control exists in exempt status that will insure responsive and accountable administrative control of the programs of the agency, board or commission.

c) For all positions currently exempt by action of the Commission, the Director of Central Management Services shall inform the Commission promptly in writing of all changes in essential functions, reporting structure, working title, work location, position title, position number or specialized knowledge, skills, abilities, licensure or certification.

d) Prior to granting an exemption from Jurisdiction B under Section 4d(3) of the Personnel Code, the Commission will notify the incumbent of the position, if any, of its proposed action. The incumbent may appear at the Commission meeting at which action is to be taken and present objections to the exemption request.

VI. CLASS SPECIFICATIONS

A. Governing Rule – Section 1.45 Classification Plan

The Commission will review the class specifications requiring Commission approval under the Classification Plan and will approve those that meet the requirements of the Personnel Code and Personnel Rules and conform to the following accepted principles of position classification:

a) The specifications are descriptive of the work being done or that will be done;

b) Identifiable differentials are set forth among classes that are sufficiently significant to permit the assignment of individual positions to the appropriate class;

c) Reasonable career promotional opportunities are provided;

d) The specifications provide a reasonable and valid basis for selection screening by merit examinations;

e) All requirements of the positions are consistent with classes similar in difficulty, complexity and nature of work; and

f) The relation of the class specifications to any applicable collective bargaining agreement.

B. CORRECTIONS STAFF DEVELOPMENT SPECIALIST I (CREATE NEW)

CORRECTIONS STAFF DEVELOPMENT SPECIALIST II (CREATE NEW)

CLASSIFICATION ANALYSIS:

The AFSCME collective bargaining agreement in effect from 2023-2027 includes a request from the union for a classification study of Staff Development Specialist I (SDS

1) positions “at both any correctional facility and corrections training academy”.

The Department of Central Management Services (CMS) Division of Personnel Integrity reviewed the current circumstances of these positions along with the Department of Corrections (DOC, the department). Both agree there are sufficient duties and responsibilities inherent to the DOC SDS 1 positions that are outside the scope of the current class specification (the SDS 1) and distinct enough from other state SDS 1 positions to warrant a new classification.

The Staff Development Specialist I class specification features a distinct emphasis on providing training to employees in career development workshops, human resources and administrative aspects of work for the state government. With respect to the DOC Staff Development Specialist I (SDS 1) positions, the nature of the work sets up conditions that require a) specialized training particular to the custody setting pre-service security and safety, orientation; and b) training tailored to student populations as well as c) the more generalized workshops for employee development that other state SDS 1s are involved in.

The SDS 1 facility training positions at DOC constitute this performance level.

The SDS 1 positions located at the department’s training academy are responsible for the same training work as the facilities based positions. Additionally, the academy training positions are focused on meeting the department’s unique training needs for a large number of its employees as part of the cadet training program. Including such classes as Correctional Officers, Correctional Counselors, Treatment Counselors, and Parole Officers through the academy program setting. These positions perform the academy training, provide administrative support for the program, contribute to and maintain the department training curricula, and facilitate trainings for staff at the department’s facilities.

The Corrections Staff Development Specialist I and Corrections Staff Development Specialist II class specifications were developed to recognize the differences between the DOC SDS 1 positions and SDS 1 positions in other state agencies and recognize a level distinction between DOC facilities positions and the training academy positions.

C. ISP TELECOMMUNICATOR TRAINEE (Establish New)

ISP TELECOMMUNICATOR LEAD SPECIALIST (Establish New)

ISP TELECOMMUNICATOR SUPERVISOR (Establish New)

CLASSIFICATION ANALYSIS:

The AFSCME collective bargaining agreement includes a provision for Central Management Services (CMS) to conduct a feasibility study of the “Telecommunicator Series (ISP). Establish Illinois State Police Telecommunicator Series with a higher paygrade and a possible Unit Clarification to move Telecommunications Supervisor to RC28 or 62 with bridge from the RC-14 Telecommunicator series.” The existing Telecommunicator classes are in need of updating/upgrading and the agency would benefit from the creation of a new series dedicated exclusively to use by the Illinois State Police (ISP). Cooperative collaboration with ISP produced a series of four proposed classes including:

• ISP Telecommunicator Trainee

• ISP Telecommunicator Specialist

• ISP Telecommunicator Lead Specialist

• ISP Telecommunicator Supervisor

CMS’ rationale for the creation of the new, dedicated series is based upon and evidenced by the uniqueness of the work functions and duties performed by ISP Telecommunicators (ISP-TCS), the incorporation and use of advanced state-of the-art technologies, the agency’s desire, willingness and ability to keep informed of innovative software advances, and exceptional training and maintenance of staff proficiency; all of which contribute to the continued safety, protection, and overall well-being of Illinois citizens.

The four proposed ISP-TCS classes are technically “new” classes. They are based upon the existing TCS classes and retain the relevant salient points, but the ISP classifications have been significantly updated to clarify language related to job functions, and to focus specifically on ISP-utilized technologies, procedures, language and other advances. The proposed ISP-TCS classifications, when implemented, will leave the Illinois Department of Corrections (IDOC) as the sole user-agency of the remaining Telecommunicator classes. CMS is concurrently working on a separate class study to revise those classes for exclusive use by IDOC going forward.

A. Civil Service Commission Governing Rule – Section 1.310 Personnel Rules

The Commission has power to disapprove new rules or amendments to existing rules submitted by the Director of Central Management Services. Such proposed new rules or amendments of existing rules submitted to the Commission shall be accompanied by a report of proceedings attending the prior public hearing required by law with respect to them. If the Commission does not disapprove new rules or any amendment to existing rules within 30 days following the receipt from the Director of Central Management Services, the new rules or amendments have the force and effect of law after filing by the Director with the Secretary of State.
